Welcome to heartblooms (“we,” “us,” or “our”), a project hosted by Martine Alonso Marquis (EU VAT number ES16641229Q). By accessing or using our website www.heartblooms.com (the “Site”), you agree to comply with and be bound by these Terms of Use (“Terms”). Please read them carefully. If you do not agree with these Terms, you should not use the Site.

 

1. Acceptance of Terms

By accessing and using the Site, you accept and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site.

 

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. It is your responsibility to check the Terms periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

 

3. Use of the Site

A. Eligibility

You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you meet this age requirement.

Subject to your compliance with these Terms, Martine Alonso Marquis grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes.

A. Ownership

All content, features, and functionality on the Site, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Martine Alonso Marquis or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

B. Third-Party Content

The Site may contain images and other media that are sourced from third-party providers under specific licenses. These include:

• Copyright-Free Images: Some images are sourced from platforms like Unsplash, which offer high-quality, royalty-free photos under their Unsplash License.

• Licensed Images: Certain images have been purchased under commercial licenses, granting us the rights to use them as needed for the Site.

• AI-Generated Images: We also use images created with artificial intelligence tools. These images are generated in compliance with the respective tool’s usage policies and guidelines.

• Partner-Provided Images: Images provided by our retreat center partner, Cuatre Finques, are used with their permission and in accordance with our partnership agreements.

 

All third-party images are used in accordance with their respective licenses, and proper attribution is provided where required. Users are prohibited from using, reproducing, or distributing any content from the Site without explicit permission.

 

5. Third-Party Services and Links

A. Payment Platforms

When you make a payment on the Site, your payment information is handled by third-party payment processors. We do not store your credit card details. By using our payment services, you agree to the terms and conditions of the respective payment platform.

 

B. Typeform Intake Forms

Our Site uses Typeform for intake forms, which collect sensitive personal information such as date of birth, gender, past relationships, dietary needs, and health situation. This information is used solely for managing your participation in our retreats and will be deleted within four weeks after the retreat concludes.

 

C. WhatsApp Connection

The Site includes a button that, when clicked, connects you to our WhatsApp contact. By using this feature, you consent to initiate a conversation via WhatsApp on your device.

 

D. External Links

Our Site may contain links to third-party websites that are not operated by us. We are not responsible for the privacy practices or content of these external sites. We encourage you to review the privacy policies of any third-party sites you visit.

 

6. Data Protection and Privacy

Please refer to our Privacy Policy for detailed information on how we collect, use, disclose, and safeguard your personal information.

 

7. Data Retention and Deletion

We retain sensitive data collected through our Typeform intake forms for four weeks after the conclusion of the retreat. After this period, all sensitive personal data will be permanently deleted from our records. Non-sensitive data may be retained as necessary to fulfill the purposes outlined in our Privacy Policy or as required by law.

 

8. User Responsibilities

You are responsible for maintaining the confidentiality of your account information, including any login credentials. You agree to notify us immediately of any unauthorised use or suspected breach of your account.

 

9. Disclaimer of Warranties

The Site is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied. Martine Alonso Marquis does not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

 

10. Limitation of Liability

In no event shall Martine Alonso Marquis, its affiliates, or their respective directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Site.

• Any conduct or content of any third party on the Site.

• Any content obtained from the Site.

• Unauthorized access, use, or alteration of your transmissions or content.

 

11. Indemnification

You agree to defend, indemnify, and hold harmless Martine Alonso Marquis and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any User Content submitted by you.

 

12. Termination

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

 

Upon termination, your right to use the Site will immediately cease. If you wish to terminate your account, you may simply discontinue using the Site.

 

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in València, Spain, for the resolution of any disputes arising out of or relating to these Terms or your use of the Site.

 

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.

 

15. Entire Agreement

These Terms constitute the entire agreement between you and Martine Alonso Marquis regarding your use of the Site and supersede all prior and contemporaneous agreements, communications, and proposals, whether oral or written.

Terms & Conditions for Retreat Bookings and Participation

 

By booking a place in a heartblooms retreat (“Retreat”), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree with these Terms, you should not book a place in a heartblooms retreat.

1. Booking and Payment

By booking your spot for the retreat, you agree to make a full, non-refundable payment. Payments can be securely made online via Stripe through our website.

2. Participant Cancellation Policy

Please know that all bookings are final and non-cancellable. Once a booking has been made, we cannot issue refunds or cancellations. Please note that the 14-day “cooling-off” period under EU law does not apply to leisure activities with specific dates, which includes our retreats. We strongly recommend purchasing travel and retreat cancellation insurance to cover unforeseen circumstances.

3. Organiser Cancellations Policy

If we cancel the retreat, you will receive a full refund of all payments made. We are not responsible for additional costs, such as flights or other travel expenses.

4. Health, Wellness, and Safety

Participation is only permitted if you are free of illness symptoms. Please kindly understand that participants showing symptoms may be asked to leave the retreat to keep all other participants as free of health risks as possible. Please note that also in these cases, we are unable to issue a refund and thus encourage you to be able to rely on adequate insurance.  You are responsible for ensuring you are physically and mentally fit to participate. Please inform us of any medical conditions, allergies, or dietary needs prior to attending. Retreat sessions are not a substitute for medical, psychiatric, or psychological treatment. If you require such support, consult a qualified professional before attending. If you are under medical or psychiatric care, or taking medications that could impact or be impacted by your retreat experience, you must inform us before the retreat.

5. Travel and Insurance

You are responsible for arranging your own travel to and from the retreat location. We strongly recommend obtaining travel and retreat cancellation insurance to cover cancellations, medical emergencies, and personal liability.

6. Code of Conduct

Participants are expected to behave respectfully toward others, staff, and the environment. Disruptive or harmful behaviour may result in removal from the retreat without a refund.

7. Liability

We are not responsible for loss, damage, or theft of personal belongings;

any injuries (mental and physical) or illnesses sustained during the retreat; 

external disruptions such as weather, political instability, or global events.

By attending, you accept full responsibility for your well-being.

 

8. Missed or Interrupted Participation

Missed sessions cannot be refunded or transferred. If you leave the retreat early, no partial refunds can be issued.

8. Programme Changes

We reserve the right to adjust the retreat schedule or content if necessary. Any significant changes will be communicated in advance.

9. Privacy and Media

Your personal data will be used only for organising the retreat and will not be shared without your consent. We retain sensitive data collected through our Google intake forms for four weeks after the conclusion of the retreat. After this period, all sensitive personal data will be permanently deleted from our records. Non-sensitive data may be retained as necessary to fulfill the purposes outlined in our Privacy Policy or as required by law.

 

10. Photos and Videos:

No photos or videos will be taken without your prior consent. If consent is given, any materials used for promotional purposes will respect your privacy and preferences.

11. Governing Law

These Terms & Conditions are governed by the laws of Spain, and any disputes will be handled in the courts of València.
